Commercial Law and Practice Seminars

The Faculty is very proud in its 50th anniversary year to be collaborating with both the Supreme Court and the Federal Court, together with other arms of the Victorian legal profession, in providing continuing professional education through a series of landmark seminars of topical relevance to commercial law and practice.

To that end, the Faculty's pre-existing involvement in the successful Commercial CPD Seminar Series continues this year under the chairmanship of Justice Clyde Croft from the Supreme Court of Victoria, with organising assistance from the Faculty and its Commercial Law Group, the Victorian Bar Association, the Law Institute of Victoria, and the Judicial College of Victoria.

The Faculty is also newly involved in a national seminar series on commercial matters within the jurisdiction of the Federal Court of Australia, in a collaboration between the Federal Court, the Commercial Bar Association of Victoria, and the Faculty and its Commercial Law Group.

Monday 17 February 2014 - Nudging for Better Health Conference
Speaker: Associate Professor Anne-Maree Farrell
Venue: Monash University Law Chambers, 555 Lonsdale Street, Melbourne

About the event: There is growing enthusiasm in government policy circles for promoting strategies designed to encourage and enable individuals to lead healthier lives. Such strategies draw on behavioural research showing individuals do not always act rationally and are susceptible to a range of influences which impact on the decisions they make. The research suggests that people can be nudged towards making decisions which are better for their health but in such a way that it does not unduly restrict their liberty or freedom to act. The seminar will bring together an interdisciplinary group of scholars and commentators to explore the use of nudge strategies to incentivise better health. Recent developments in relation to the use of such strategies in Australia, NZ, the UK and Europe will be examined, as will case studies in specific areas impacting upon individual and collective health and wellbeing.

Reproductive Freedom, Torture and International Human Rights
Challenging the Masculinisation of Torture

By Dr Ronli Sifris

This book contributes to a feminist understanding of international  human rights by examining restrictions on reproductive freedom through the lens of the right to be free from torture and other cruel, inhuman or degrading treatment. Ronli Sifris challenges the view that torture only takes place within the traditional paradigm of interrogation, punishment or intimidation of a detainee, arguing that this traditional construction of the concept of torture prioritises the experiences of men over the experiences of women given that the pain and suffering from which women disproportionately suffer frequently occurs outside of this context. She does this by conceptualising restrictions on women’s reproductive freedom within the framework of the right to be free from torture.

Tuesday 18 March 2014 – National Commercial Law Seminar Series

About the event:  In 2013 we introduced a National Commercial Law Seminar Series as a joint initiative of the Federal Court of Australia, the Commercial Law Group, Faculty of Law, Monash University and the Commercial Bar Association, The Victorian Bar. Evening seminars were held throughout the year at the Federal Court of Australia which showcased commercial law themes presented by eminent speakers from the Federal Court, Monash University and the Commercial Bar.

The series was very well received by the commercial legal profession and dealt with topics such as ‘Unconscionability and good faith in business transactions’ and ‘Current issues in the Interpretation of Federal Legislation’.

We look forward to continuing this series again this year and hope that you will find one of interest.
